993. The Tribunal further finds that China has, through its island-building activities at Cuarteron Reef, Fiery Cross Reef, Gaven Reef (North), Johnson Reef, Hughes Reef, Subi Reef and Mischief Reef, breached Articles 192, 194(1), 194(5), 197, 123, and 206 of the Convention.

1043. Based on the considerations outlined above, the Tribunal finds that China has, through its construction of installations and artificial islands at Mischief Reef without the authorisation of the Philippines, breached Articles 60 and 80 of the Convention with respect to the Philippines’sovereign rights in its exclusive economic zone and continental shelf. The Tribunal further finds that, as a low-tide elevation, Mischief Reef is not capable of appropriation.

1109. Based on the considerations outlined above, the Tribunal finds that China has, by virtue of the conduct of Chinese law enforcement vessels in the vicinity of Scarborough Shoal, created serious risk of collision and danger to Philippine vessels and personnel. The Tribunal finds China to have violated Rules 2, 6, 7, 8, 15, and 16 of the COLREGS and, as a consequence, to be in breach of Article 94 of the Convention.

1181. Based on the considerations outlined above, the Tribunal finds that China has in the course of these proceedings aggravated and extended the disputes between the Parties through its dredging, artificial island-building, and construction activities.

China shall respect the rights and freedoms of the Philippines under the Convention, shall comply with its duties under the Convention, including those relevant to the protection and preservation of the marine environment in the South China Sea, and shall exercise its rights and freedoms in the South China Sea with due regard to those of the Philippines under the Convention.

Tòa PCA không ra phán quyết về luận cứ 15 này, vì các điểm trong luận cứ đã được nêu ra trong Công Ước UNCLOS mà 2 bên phải tuân thủ.

1201. The Tribunal considers it beyond dispute that both Parties are obliged to comply with the Convention, including its provisions regarding the resolution of disputes, and to respect the rights and freedoms of other States under the Convention. Neither Party contests this, and the Tribunal is therefore not persuaded that it is necessary or appropriate for it to make any further declaration.

Tóm lại, Phán Quyết Tòa PCA ngày 12 tháng 7, 2016, sau hơn 3 năm rưỡi thụ lý hồ sơ kiện Trung Cộng của Phi Luật Tân đã xác nhận hơn 90% (14/15) luận cứ của Phi, bác bỏ luận cứ Chủ Quyền Từ Lịch Sử và Đường Lưỡi Bò 9 Đoạn của Trung Cộng, và còn xác nhận một cách mạnh mẽ các hành động vi phạm chủ quyền Phi của TC và vi phạm các điều khoản liên hệ trong Công Ước UNCLOS.

Chưa bao giờ một cường quốc coi rất trọng tư thế, sĩ diện như TC lại bị một vố đau như vậy trên trường quốc tế. Phán Quyết này bẻ gãy mưu đồ xâm chiếm Biển Đông về mặt công pháp quốc tế, tái xác định chủ quyền các quốc gia khác như Malaysia, Singapore, Indonesia, Brunei, Phi Luật Tân, Việt Nam trên vùng EEZ của mỗi quốc gia được quy định theo UNCLOS.

Âm mưu rộng lớn tiến chiếm Biển Đông tiến hành từ hơn 20 năm nay với sự hỗ trợ đắc lực của tay sai lãnh đạo đảng CSVN bị khựng lại khi nền tảng pháp lý bị phán quyết 12 thàng 7, 2016 của Tòa PCA bẻ gẫy.
