Kính gửi Ngài Cao Ủy Tỵ Nạn,

Chúng tôi viết thư này để bày tỏ mối quan tâm về tình trạng an nguy của những người tỵ nạn Việt Nam tại Thái Lan, đang gặp nguy cơ bị bắt cóc và cưỡng bách trở về Việt Nam bởi đặc vụ của nhà nước Cộng Hòa Xã Hội Chủ Nghĩa Việt Nam.

Vụ bắt cóc blogger Đường Văn Thái vào ngày 11 tháng 4, 2023 là vụ thứ nhì mà đặc vụ Việt Nam bắt cóc người tỵ nạn tại Thái và cưỡng bách họ trở về Việt Nam để bị xét xử vì các bài viết của họ. Có lẽ Ông đã biết, Đường Văn Thái (dùng bút hiệu Thai Van Duong) chạy trốn qua Thái Lan vào năm 2018 và nộp đơn xin quy chế tỵ nạn và đang chờ được định cư ở nước thứ ba theo chương trình Tái Định Cư Tỵ Nạn của Liên Hiệp Quốc.

Vào tháng Giêng 2019, ký giả Trương Duy Nhất cũng tình nghi là bị mật vụ Việt Nam bắt cóc tại Thái Lan trong khi xin tỵ nạn. Nhà cầm quyền Việt Nam sau đó kết án ông Trương Duy Nhất 10 năm tù giam về tội “lợi dụng chức vụ, quyền hạn khi thi hành công vụ.”

Những vụ bắt cóc này, và bị giam giữ tùy tiện sau đó, là sự vi phạm trắng trợn luật lệ quốc tế về tỵ nạn và nhân quyền. Những hành vi đàn áp xuyên quốc gia này được các chế độ hà khắc sử dụng để tiếp tục bịt miệng và đe dọa quyền tự do biểu đạt của những tiếng nói đối kháng, vượt ra khỏi biên giới quốc gia.

Chúng tôi kêu gọi Cao Ủy Tỵ Nạn LHQ chú tâm đặc biệt đến các trường hợp này và có những biện pháp cần thiết để bảo vệ người tỵ nạn Việt Nam tại Thái Lan không bị bắt cóc và cưỡng bách về lại Việt Nam. Các biện pháp bao gồm:

– Thực hiện các lượng giá rủi ro cho những người xin tỵ nạn đã được cấp quy chế tỵ nạn nhằm xác định xác suất bị tấn công bạo hành, kể cả bắt cóc và cưỡng bách về Việt Nam, và để tiến hành các biện pháp bảo vệ cụ thể.

– Thúc đẩy nhanh hơn thủ tục tái định cư đệ tam quốc gia, để có được một nơi an toàn hơn là Thái Lan cũng như tránh bị cưỡng bách về Việt Nam.

Cao Ủy Tỵ Nạn LHQ đóng vai trò quan trọng trong việc bảo vệ quyền hạn và sự an nguy của người tỵ nạn. Chúng tôi đề nghị Ông kêu gọi chính quyền Việt Nam hãy trả tự do ngay lập tức cho các ông Đường Văn Thái, Trương Duy Nhất và những người tỵ nạn hay các nhà bảo vệ nhân quyền khác đã bị bắt cóc tại nước ngoài đem về Việt Nam.

Dear High Commissioner for Refugees,

We are writing to express our concern about the safety and wellbeing of Vietnamese refugees and asylum seekers in Thailand, who are at risk of abduction and refoulement by agents of the Socialist Republic of Vietnam.

Blogger Duong Van Thai’s disappearance on April 14, 2023, is the second known case in which Vietnamese agents reportedly abducted a Vietnamese refugee in Thailand and forcibly returned the individual to Vietnam to face persecution for their writings^[1]. As you may be aware, Duong Van Thai (who publishes under the name Thai Van Duong) fled to Thailand in 2018 and applied for refugee status, waiting to be relocated to a third country under the UN Refugee Resettlement program.

In January 2019, journalist Truong Duy Nhat was also allegedly abducted in Thailand by Vietnamese security agents while seeking asylum. The Vietnamese authorities subsequently sentenced Truong Duy Nhat to 10 years of imprisonment for “abusing his position and power while on duty.”

These reported abductions, followed by arbitrary detention, are a clear violation of international refugee law and human rights law. These acts of transnational repression are also conducted as a means for repressive regimes to continue to silence and threaten the freedom of expression of dissident voices, even beyond national borders.

We urge the UNHCR to pay closer attention to these cases and take all necessary measures to protect Vietnamese refugees and asylum seekers in Thailand from abduction and refoulement. This includes:

– Carrying out risk assessments of Vietnamese asylum seekers and individuals granted refugee status in order to determine the risk of physical attacks, including abductions and illegal transfer to Vietnam that they face, and implement effective protection measures

– Speeding up the resettlement procedure in a third country for refugees in order to provide a safe and secure alternative to remaining in Thailand or being forcibly returned to Vietnam.

The UNHCR has a vital role to play in protecting the rights and safety of refugees and asylum seekers. We urge you to call on the Vietnamese government to immediately release Duong Van Thai, Truong Duy Nhat, and any other Vietnamese asylum seeker and/or human rights defender who was previously abducted on foreign soil.
